Campaign Finance Training - Jan/Feb 2019

Philadelphia's Board of Ethics and City Commissioners are pleased to jointly offer campaign finance training covering the basic requirements of Philadelphia's campaign finance law and the State Election Code. The training will also cover the nuts and bolts of how to electronically file campaign finance reports with the Board.

Training will be held on the following dates:

February 12, 2019 @ 5:00PM
February 27, 2019 @ 12:00PM

Amendment to Regulation 1 (Campaign Finance) Effective as of December 10, 2018

On November 28, 2018, the Board of Ethics gave final approval to an update to Regulation No. 1 (Campaign Finance). The new version of the regulation became effective as of December 10, 2018 and it applies from that date forward.  Attached is the Hearing Report approved by the Board and the updated Regulation No. 1.

Ethics Board Settlement Agreements - 11/29/2018

The Board of Ethics has approved four Settlement Agreements:

Greater Philadelphia Association of Realtors & Samar Jha: resolving violations of the Philadelphia Lobbying Law for (1) the failure by GPAR to register as a principal, (2) the failure by Mr. Jha to register as a lobbyist, and (3) the failure by GPAR to timely file an expense report.

Paris Washington, Sr.: resolving a violation of Philadelphia Home Rule Charter Section 10- 102 as a result of entering into a contract to supply notary services to the Sheriff’s Office.

Patrick Jones: resolving violations of the political fundraising restrictions of Philadelphia Home Rule Charter Section 10-107(3) for (1) being involved in the fundraising activities of a political committee and, (2) creating fundraising fliers for City, congressional, and judicial candidates.

Verna Brown-Tyner: resolving three violations of Philadelphia Code Section 20-602 arising from Ms. Brown-Tyner’s representation of a non-profit in transactions involving the City.

Public Hearing Scheduled for Proposed Amendment to Board Regulation No.1 (Campaign Finance)

On September 12, 2018, the Board approved for public comment a proposed amendment to Board Regulation No. 1 (Campaign Finance). The Board has posted the proposed amendment at the Records Department and scheduled a public hearing for October 17, 2018 at 1:00PM in Room 18-020 at One Parkway Building, 18th Floor, 1515 Arch Street. At the hearing, members of the public are invited to offer testimony on the proposed amendment.

A copy of the proposed amendment is attached to this email. Notable proposed changes include:

  • Striking of the limits on aggregate PAC contributions in non-election years in light of decision not to enforce these limits due to U.S. Supreme Court ruling in McCutheon v. FEC, 572 U.S. 185, current Paragraph 1.5
  •  New guidance on date of acceptance of in-kind contributions, Paragraph 1.14(b)
  •  Guidance on disclosure of expenditures made via credit card, Paragraph 1.23(a)(iii)
  • Guidance on use of Payment Service Providers such as PayPal, Paragraph 1.25(c)

The Board of Ethics has approved five Settlement Agreements:

Beth Grossman and Friends of Beth Grossman - Resolves violations of the City's Campaign Finance Law for accepting excess contributions and failing to properly file campaign finance reports with the Board.

Friends of the 57th Ward Democrats and Ken Cunningham - Resolves violations of the City's Campaign Finance Law for failure to timely file required campaign finance reports with the Board in 2017.

Melanie Johnson - Resolves a violation of the conflict of interest restrictions for making purchases for her personal benefit from accounts held by the Fund for Philadelphia, Inc. and Wawa Welcome America, Inc.

Richard Lazer - Resolves a violation of the City Home Rule Charter's political fundraising restrictions for being involved in soliciting contributions for Friends of Rich Lazer.

Ward 44 PAC and Willie Jordan - Resolves violations of the City's Campaign Finance Law for failing to timely file required campaign finance reports with the Board in 2017.

Philadelphians for a Fair Future, et al. - Resolves violations for making material misstatements and omissions in a registration and expense report submitted to the Board as well as for the failure of several lobbyists and lobbying firms to register with the Board.

47th Ward Democratic Executive Committee and George Brooks - Resolves violations for failing to timely file campaign finance reports with the Board for 2017 Cycle 3 and Cycle 6.

Asian American Licensed Beverage Association - Resolves two violations of the City's Lobbying Law for failing to register in 2017 and submit a Q4 expense report.

Tariq El-Shabazz and Taylor Daukaus - Resolves three violations of the City's Campaign Finance Law related to the 2017 campaign for District Attorney including failure to disclose in-kind contributions, acceptance of excess in-kind contributions, and exercising control over and directing the expenditures of Trustwave PAC through agents of the campaign.
