GENERAL DEFINITION

This is supervisory level inspection and code enforcement work. Employees in this class direct the activities of a group of field employees performing inspections, investigations and related code enforcement work to determine conformance to the provisions of local statutes, ordinances, codes, regulations and standards governing commercial and business activities or commercial weighing and measuring devices.

Employees in this class may also conduct inspections which involve more complex and sensitive cases. Contact with commercial and industrial representatives, officials of governmental agencies and the general public is significant to the work. Work may include exposure to potentially hazardous conditions. Work is performed under the direction of a technical supervisor.

ALLOCATING FACTORS: (The following conditions must be met for a position to be allocated to this class.)

Positions must supervise a group of field personnel engaged in conducting inspections, investigations, and related code enforcement work in the area of specialization.
Positions must be located in the Regulatory Enforcement Division of the Department of Licenses and Inspections.

BOTH SPECIALTIES

Supervises the activities of field personnel engaged in inspections, investigations and related code enforcement work; resolves the more complex inspection and enforcement problems; recommends strategies to obtain code compliance; participates in special inspectional and enforcement programs; directs the conduct of non-routine, sensitive or complex inspections.
Discusses the nature of violations and code requirements with business representatives, attorneys and law enforcement officials; explains steps necessary to obtain compliance; conducts training of subordinates regarding inspectional methods and techniques, and the interpretation of applicable laws, regulations and ordinances; oversees the activities of a clerical staff maintaining records and processing violations.
Assigns inspection staff to perform follow-up inspections; allows violators specified time periods to correct violations; determines compliance to reinspection programs.
Prepares and maintains a variety of inspection and investigation records and reports; reviews inspection reports of subordinates for accuracy and completeness.
Performs related work as required.

BUSINESS COMPLIANCE SPECIALTY

Supervises the activities of a staff engaged in inspecting and enforcing ordinances governing commercial and business activities; makes recommendations regarding rejection or approval of licenses relating to areas such as specific commercial activity on public streets, the use of commercial vehicles, the transportation of explosives throughout the city, and vending operations during major stadium and related events; trains subordinates in the inspection of hazardous materials; orders subordinates to confiscate merchandise or cease business operations, including those businesses identified as public nuisances; assists subordinates with special cease operations which may be sensitive and require law enforcement assistance; may be exposed to high crime areas of the city when assisting subordinates in the field; presents information and testimony at administrative or court hearings concerning violations.
Directs subordinates in conducting various zoning inspections which include the issuance of zoning violations for commercial and residential properties; directs subordinates in inspections involving the measurement of properties and/or structures to determine accurate dimensions and/or other features of properties; reviews plot plans drafted by subordinates to ensure accuracy; assists subordinates in the use of measuring devices used to inspect properties and/or structures; testifies at Zoning Board hearings involving completed inspections; oversees the enforcement of ordinances and regulations dealing with tobacco, handbill distributions and dumpsters.

WEIGHTS AND MEASURES SPECIALTY

Supervises the activities of a staff engaged in inspecting and enforcing laws, regulations and ordinances pertaining to weighing, measuring and counting devices; interprets the application of laws, regulations and ordinances pertaining to weighing, measuring and counting devices including pertinent aspects of weigh-master, motor fuel inspection, packaging and labeling, sale of commodities, unit price, open date, octane testing, national type evaluation and scanner legislation; directs the inspection of bar-code scanners and parking garage timing devices to ensure accuracy; monitors web sites of Philadelphia based companies to guard against price misrepresentation and/or bait and switch techniques under the authority of the National Institute for Standards and Technology (NIST); orders commodities off sale; recommends purchase of a variety of measuring and testing apparatus; ensures that testing apparatus is calibrated for accuracy according to schedule.

REQUIRED KNOWLEDGE, SKILLS AND ABILITIES

KNOWLEDGE OF:

methods and techniques of dealing with the public affected by applicable codes, regulations, and ordinances
procedures utilized in the prosecution of violations of applicable codes, ordinances and statutes in the area of specialization

safe practices relating to various types of hazardous materials for the Business Compliance specialty

approved measuring, weighing, and counting devices commonly used in commerce and industry, and the methods and equipment used to test and calibrate such devices for the Weights and Measures specialty
the basic operations of a wide variety of weighing, measuring, and counting devices for the Weights and Measures specialty
methods used to defraud the public by the use of short weights and measures for the Weights and Measures specialty
the standards/regulations of the National Institute for Standards and Technology (NIST) for the Weights and Measures specialty

SKILL IN:

interpreting and enforcing applicable statutes, ordinances, and regulations impartially, firmly, and tactfully
supervising and coordinating the activities of field inspectional and enforcement personnel
using a considerable degree of tact, diplomacy and judgment when dealing with the general public

MINIMUM ACCEPTABLE TRAINING AND EXPERIENCE (The following statement represents the minimum training and experience standards which will be used to admit or reject applicants for tests. Applications submitted by candidates for this class will be reviewed based on training and experience requirements as approved on 9/02.)

EDUCATION

Equivalent to completion of the twelfth school grade.

AND

SPECIFIC EXPERIENCE

BUSINESS COMPLIANCE SPECIALTY

Two years of experience conducting inspections, investigations, and related enforcement activity to determine and effect compliance to ordinances and regulations governing commercial and business activity.

WEIGHTS AND MEASURES SPECIALTY

Two years of experience performing inspectional and enforcement work testing and certifying the accuracy of weighing, measuring, and counting devices used for commercial transactions.

Any equivalent combination of education and experience that has included the specific experience described above.

PHYSICAL AND MEDICAL REQUIREMENTS

Ability to physically perform the duties and to work in the environmental conditions required of a position in this class.

LICENSES, REGISTRATIONS AND/OR CERTIFICATES

Possession of a valid proper class motor vehicle operator's license as issued by the Commonwealth of Pennsylvania prior to appointment and during tenure of employment as an L and I Regulatory Enforcement Supervisor.
Possession of federal certification by the National Institute of Standards and Technology (NIST) is required for positions in the Weights and Measures specialty.
