MINORITY/DISADVANTAGED BUSINESS ENTERPRISE SPECIALIST 2

 

GENERAL DEFINITION

 

            This is affirmative action contract compliance work at the full performance level review­ing bids, contracts and compliance plans, and participating in the certification of minority/disadvantaged business firms.  The employee is responsible for reviewing applications for certification, interviewing business firm representatives, reviewing financial records, and monitoring contracts for compliance with federal, state, and local affirmative action guidelines and regulations.  Work includes analyzing certified minority/disadvantaged, disabled, and female owned and controlled firms to determine their level of participation prior to bidding, and whether that firm is performing a commercially acceptable function.  Work differs from that of the next lower class in that employees are assigned to projects of greater scope and complexity requiring the exercise of greater independence of judgement.  Significant to the work is establishing and maintaining effective working relationships with representatives of departments, agencies, and businesses.  Work is performed under the supervision of a technical superior and may involve rotating assignments between units.

 

 ALLOCATING FACTORS: (The following conditions must be met for a position to be allocated to this class.)

 

  1. Positions must perform full performance level contract compliance work reviewing bids and contracts for disadvantaged business participation.
  2. Positions must certify business enterprises as minority/disadvantaged, disabled and/or female owned and controlled.
  3. Positions must be assigned the more complex compliance projects requiring the exercise of greater independence of judgment.
  4. Positions must perform the work in the Commerce Department.

 

TYPICAL EXAMPLES OF WORK (ILLUSTRATIVE ONLY)

 

            Receives applications from minority/disadvantaged, disabled, and female controlled firms requesting certification; reviews applications for accuracy, completeness, and conformance to affirmative action guidelines and regulations; requests additional information and financial, legal, and/or technical documents as needed; analyzes documentation to determine or confirm minority/disadvantaged, disabled, or female ownership and control of firm, viability, and contractual relationships; approves or denies applications; assigns commodity codes to certified firms specifying goods and/or services that they are approved to deliver; determines disadvantaged firms' level of participation.

            Reviews bids for conformance to governmental guidelines and applicability for apportionment to disadvantaged sub-contractors; places ranges on bids for personal and professional services such as architectural and engineering projects, on bids for public works such as water purification and wastewater treatment construction projects, and on bids for supplies, services and equipment contracts where applicable; contacts primary contractors for agreement to sub-contract to minority/disadvantaged, disabled, or female owned and controlled firm participation; recommends disapproval of contractor if non-responsive; confirms compliance of bids with guidelines; monitors and reviews awarded contracts for compliance with affirmative action laws, rules, and regulations.

            Conducts telephone, personal, and on-site interviews; questions firms' representatives about their financial status and control; inspects work site to determine if the firm can reasonably perform the type of work for which it has been certified or for which it is applying; investigates company capital, licenses, technical, financial, and human resources; evaluates business firms to determine the level of participation possible in procurement process; documents findings; testifies to findings at hearings.

            Conducts and attends meetings with prospective firms, certified firms, departmental representa­tives, and associates concerning certification and compliance; resolves contract language discrepancies; provides counseling on procurement processes and procedures; provides technical assistance and direction to certified firms in the assignment of commodity codes. 

            Performs related work as required.

 

REQUIRED KNOWLEDGE, SKILLS AND ABILITIES

 

KNOWLEDGE OF:

 

·                     federal, state, and/or local affirmative action and equal opportunity laws and regulations as they apply to the selection of minority/disadvantaged, disabled and female vendors

·                     the practices, methods, and procedures used in public procurement processing

·                     the procedures and techniques applied in the review and approval of certification applications and compliance reviews

·                     contract compliance methods and procedures as they relate to minority /disadvantaged, disabled, and female owned and controlled business enterprises

·                     current developments in contract compliance and equal opportunity laws and regulations

·                     rules and regulations governing the purchase of municipal commodities

·                     the City's buying and bidding procedures

·                     accounting procedures, methods and practices

·                     interviewing principles and techniques

·                     establish and maintain effective working relationships with superiors, associates, contractors, vendors, representatives of other City agencies and departments, and the general public

 

MINIMUM ACCEPTABLE TRAINING AND EXPERIENCE (The following statement represents the minimum training and experience standards which will be used to admit or reject applicants for tests. Applications submitted by candidates for this class will be reviewed based on training and experience requirements as approved on 2/22.)

 

EDUCATION:

 

            Completion of a bachelor's degree program at an accredited college or university.

 

AND

 EXPERIENCE:

 

            Two years of experience in affirmative action contract compliance and certification work ensuring compliance with rules, regulations, and guidelines, and encouraging the selection of minority/disadvantaged, disabled , and female owned and controlled enterprises

 

OR

 

            Two years of administrative experience interpreting regulations, laws, and procedures applicable to affirmative action to encourage compliance with stakeholders.

 

 

NOTE:  Completion of a master’s degree or certificate program from an accredited college or university or recognized professional association in a related field may substitute for one year of the required experience.

 

 

OR

 

            Any equivalent combination of education and experience determined to be acceptable by the Office of Human Resources that has included a bachelor’s degree as an educational minimum.

 

PHYSICAL AND MEDICAL REQUIREMENTS

 

            Ability to physically perform the duties and to work in the environmental conditions required of a position in this class.
