(1) Neutering of Adopted Animals.

(a) Any adult dog or cat adopted from an animal shelter shall be neutered by a licensed veterinarian within one (1) month of adoption.

(b) Any dog or cat adopted from an animal shelter that is not an adult shall be neutered by the age of eight (8) months.

(c) If a licensed veterinarian makes a written determination that such dog or cat is physically unable to undergo surgical sterilization within the enumerated time limitations, the dog or cat shall be neutered at a time determined by the veterinarian.

(2) Reclamation of Adopted Animals.

(a) Notwithstanding the provision for penalties upon violations of this Section, any dog or cat not neutered in accordance with subsection (1) may be reclaimed by the animal shelter without refund or any adoption fee or sterilization deposit.
