7. GENERAL REQUIREMENTS FOR APPLICANTS
7.01 - GENERAL PROVISIONS. General requirements for admission to Civil Service examinations are as follows:
The applicant must:
7.011 - CITIZENSHIP REQUIREMENTS. Notwithstanding any provisions to the contrary in Section 3-306 of the Philadelphia Home Rule Charter, non-citizens who have been approved by the Immigration and Naturalization Service of the U.S. Government as permanent residents shall be eligible for appointment for any position in the Civil Service unless the job classification for which they are candidates is such that it must be limited to citizens of the United States for security purposes or other justifiable reasons.
7.012 - Be no younger than the minimum nor older than the maximum age limit as announced in the official examination announcement.
7.013 - Meet the residence requirements defined in Regulation 30 and stated in the official announcement.
7.014 - Make application on the form prescribed and furnished by the Director.
7.015 - File the application on or before the date stated in the official announcement as the last date to file.
7.02 - PUBLIC NOTICE. The Director shall give public notice to each competitive entrance examination, including the proposed parts and weights, at least fifteen (15) days in advance of such examination by release of information to the press, by advertising, if appropriate, and by posting notice of such examination through such media as he/she may determine best suited to the dissemination of information to qualified applicants for the positions in question including, when appropriate, the leading colleges, universities and other schools in the Philadelphia area.
7.03 - OPEN APPLICATION PERIOD. Whenever the Director finds that there is a shortage of qualified candidates for classes of positions in which there exists an urgent need for employees, he may announce, in the public notice of the examination, that no time limit has been established for receiving applications and he may receive applications for such period of time not less than fifteen (15) days as he finds necessary to establish a satisfactory eligible list. When such a list has been established, he shall give public notice that no further applications will be received.
7.05 - VETERANS PREFERENCE FOR SERVICE IN THE ARMED FORCES. The benefits of the Military Affairs Act of the Commonwealth of Pennsylvania shall be granted to all soldiers, to the widows and widowers of soldiers and to the spouses of disabled soldiers, as those terms are defined in the Act, who served in the Armed Forces of the United States, the National Guard or Reserves, or in any women's organization officially connected with the Armed Forces on or after December 7, 1941. Such service must have included completion of basic training.
CLAIM AND PROOF OF ELIGIBILITY FOR VETERANS' PREFERENCE. Veterans' Preference shall be granted to applicants under the following conditions:
7.051 - Time Limitations for Claiming Veterans' Preference. An applicant may claim Veterans' Preference at any time after the date the examination is announced until the eligible list that is established as a result of the examination expires or is replaced or abolished. The applicant must satisfy all requirements for Veterans' Preference at the time that the first part of the examination is administered.
7.052 - Procedure for Establishing Claim for Veterans' Preference. An applicant may claim Veterans' Preference at the appropriate place on the application for examination. If the applicant fails to claim Veterans' Preference on the application, it may be claimed by submitting such claim in writing to the Director. Applicants who have claimed Veterans' Preference in a proper and timely manner must furnish documentary proof of their right to such preference before the preference will be granted. Veterans' Preference, properly claimed, may be granted at any time between the date the eligible list is established and the date the eligible list expires or is abolished. Candidates who qualify for this preference and who take and pass open competitive civil service examinations shall have ten (10) points added to their final score. The candidate must successfully pass all parts of the examination before points are awarded.
7.053 - Effect of Late Submission of Proof of Eligibility for Veterans' Preference on Prior Appointments and Certification. An eligible who has made a proper and timely claim shall be granted Veterans' Preference as of the date acceptable proof is received by the Director. If an eligible does not prove his or her right to Veterans' Preference until after appointments and certifications have been made, the granting of such Veterans' Preference shall have no effect on appointments and certifications made prior to submission of proof and the granting of Veterans' Preference.
7.054 - Evidence of Acceptable Proof. The following kinds of evidence will be accepted as proof of right to Veterans' Preference:
7.06 - NON-WAIVER OF WORKMEN'S COMPENSATION ACT PROVISIONS. No person shall be appointed to or retained in the civil service of the City who has rejected or waived the elective compensation provisions of the Pennsylvania Workmen's Compensation Act, as amended, or the Pennsylvania Occupational Disease Act, as amended.
7.07 - DISCRIMINATION. No person shall be appointed or promoted to, or demoted or dismissed from, any position in the civil service, or in any way favored or discriminated against with respect to employment in the civil service because of his race, color, religion, national origin, political opinions or labor union activity lawful for municipal employees. No officer or employee and no department, board or commission of the City shall in the exercise of his or its powers and the performance of his or its duties or in the granting of the use of City property discriminate against any person because of race, color, religion or national origin but this paragraph shall not prohibit the use of City property by any fraternal, religious or sectarian organization.
7.08 - DATE AS OF WHICH ELIGIBILITY IS DETERMINED. In determining whether a candidate possesses the announced requirements of education or number of years of experience or age or licensure or permanent Civil Service status or service in a department, the date as of which eligibility is determined shall be the thirtieth (30) day after the last date for filing applications for that examination unless the Director determines that a later date is more appropriate in order to anticipate eligibility and specifies such later date in the announcement of the examination. For a continuous examination the eligibility date shall be the date on which the application is filed.
When the later date is later than the date on which the eligible list is established, a competitor passing the examination shall have his name placed on the eligible list but shall not be certified until and unless he has met all eligibility requirements on or before such later date.
7.081 - DATE AS OF WHICH ELIGIBILITY IS DETERMINED FOR CLASSES THAT REQUIRE COMPLETION OF A BACHELOR'S DEGREE OR A MASTER'S DEGREE. Candidates for an entry level class that requires completion of a bachelor's degree or a master's degree may compete in the examination for that class up to nine months prior to their anticipated date of graduation. Candidates must meet all education requirements for the class no later than nine months after the last date for filing applications for the examination; or, for a continuous examination, no later than nine months after the date on which the application is filed. Any candidate who does not meet all education requirements for the class within the nine month period defined above will have his or her name removed from the eligible list for the class in accordance with Regulation 10.09. Candidates who have passed the examination for the class may be contingently certified and selected in accordance with the provisions of Regulation 11 prior to their anticipated date of graduation. Such candidates may not be appointed until they provide the Director with proof of meeting all requirements for the class. The contingent certification will automatically become void if this proof is not provided to the Director within the nine month period defined above.
7.09 - REQUIREMENT FOR CLASSES REQUIRING COMPLETION OF COLLEGE COURSEWORK OR DEGREE PROGRAM. For any class that requires completion of college coursework or a degree program to qualify to compete in an examination for that class:
7.10 - LEGACY PREFERENCE IN OPEN COMPETITIVE EXAMINATIONS FOR THE CHILDREN OF PHILADELPHIA FIREFIGHTERS OR POLICE OFFICERS WHO WERE KILLED OR DIED IN THE LINE OF DUTY. The children of Philadelphia Firefighters or Police Officers who were killed or died in the line of duty shall be accorded a preference in open competitive civil service entrance examinations. Candidates who qualify for this preference and who take and pass open competitive civil service examinations shall have ten points added to their final score. The candidate must successfully pass all parts of the examination before points are awarded.
The Line Of Duty will be defined as working in an official capacity in one of the uniformed classes in the Police and Fire series of classes for the City of Philadelphia.
The child of a Philadelphia Firefighter or Police Officer will be defined as biological and adopted children, stepchildren, and children to whom the Police Officer or Firefighter stood in loco parentis.
Time limitations for claiming the preference, the procedure for establishing a claim for preference and the effect of late submission of proof of eligibility for preference on prior appointments and certification shall be the same as defined for Veterans' Preference in Regulations 7.051, 7.052 and 7.053.
An applicant may claim preference at the appropriate place on the application for examination, or if the applicant fails to claim preference on the application, it may be claimed by submitting such claim in writing to the Director. Applicants who have claimed preference in a proper and timely manner must furnish documentary proof of their right to such preference before the preference will be granted. The following kinds of evidence will be accepted as documentation of right to preference:
Legacy Preference, properly claimed, may be granted at any time between the date the eligible list is established and the date the eligible list expires or is abolished.
7.101 - LEGACY PREFERENCE IN OPEN COMPETITIVE EXAMINATIONS FOR THE GRANDCHILDREN OF PHILADELPHIA FIREFIGHTERS OR POLICE OFFICERS WHO WERE KILLED OR DIED IN THE LINE OF DUTY. For all eligible lists published on or after the date that this sub-section of Regulation 7.10 becomes effective, Legacy Preference as described above shall be granted to the grandchildren of Philadelphia Firefighters or Police Officers who were killed or died in the line of duty.
The grandchild of a Philadelphia Firefighter or Police Officer will be defined as biological and adopted grandchildren, grand-stepchildren, and grandchildren to whom the Police Officer or Firefighter stood in loco parentis.
Applicants who have claimed preference in a proper and timely manner must furnish documentary proof of their right to such preference before the preference will be granted. The following kinds of evidence will be accepted as documentation of right to preference:
All other provisions of Regulation 7.10 will apply to Regulation 7.101
