Claims Unit

Kenneth S. Butensky, Chief Deputy City Solicitor

The lawyers in the Claims Unit are quickly exposed to depositions, expert witnesses, pretrial conferences, negotiations, arbitrations and trials. Whether representing a police officer in an automobile accident involving a police pursuit, or defending the Water Department from claims for private property damage due to a water main break, the efforts of the Claims lawyers ensure that legitimate claims are settled quickly at as low a cost as possible, and claims lacking merit are vigorously defended at trial or arbitration. Claims attorneys work closely with traffic engineers, accident reconstructionists and various medical experts.

In addition to defending the City in State Court tort actions, the Unit seeks defense and indemnification for the City from independent contractors based upon contractual obligations, or tenants based on the lease of City owned facilities.

Ken Butensky supervises the Claims Unit, counsels various City agencies and directs the Unit’s clinical programs with Temple and Drexel law schools. Before joining the Law Department, he served as Law Clerk to the Hon. Richard B. Klein, Philadelphia Court of Common Pleas. As an Assistant City Solicitor in the Code Enforcement Unit, Ken prosecuted environmental, business regulation and life-safety matters. In the Claims Unit, Ken represented the City in tort and insurance coverage litigation and then supervised the General Trials Division as Divisional Deputy City Solicitor. For fifteen years, Ken also served as General Counsel to the City’s Board of License and Inspection Review. Ken is a graduate of Boston University and Temple Law School.
